Professional Liability Insurance
If you are providing CPR training, first aid instruction or any form of health and safety education, you should have your own professional liability insurance policy. Even if you receive Professional Liability coverage through an employer (Fire Dept. Hospital, Ambulance Service, etc.), odds are you will not be insured for any independent training or instruction you perform outside the scope of your official position.

General Liability Insurance
General Liability Insurance is designed to protect your business assets if your company is sued for something it did or didn't do that results in bodily injury or property damage to someone else. It may protect you from an array of disasters ranging from major fires to minor falls by a student in one of your classes.

EMP Canada and McFarlan Rowlands Insurance Brokers Inc. are pleased to confirm that: through our combined efforts we have secured an insurance program for the Occupational First Aid Attendants that have become qualified under both the programs offered by EMP Canada Services Ltd. and Worksafe BC.

This coverage is offered to qualified members of EMP Canada and/or the Occupational First Aid Attendants Association of B.C. Applications are available through the insurance office, though the EMP office, or through the Internet. The coverage will be issued effective the date the completed, signed application is received in our office, along with full payment faxes/emails are acceptable. Once the application is received, a Certificate of Insurance will be processed and mailed to you.

IMPORTANT NOTE: Errors and Omissions insurance is written on a claims-Made" form of coverage. In this connection, insurance must be in place at the time a claim is submitted in order for coverage to respond. It is of utmost importance the insurance continues to be renewed each year without any lapse in the coverage.

Instructor Liability / Errors & Omissions Insurance

EMP Canada together with McFarlan Rowlands Insurance Brokers Inc., have put together the most comprehensive and cost effective professional liability insurance plan for health and safety raining professionals available. MEDIC FIRST AID's insurance program provides coverage for CPR, First Aid, AED and Occupational First Aid instructors under one unique policy.

In addition, we are able to make available Training Centre Insurance which I believe is priced at the most economical cost available in Canada. For Training Centres who have an interest in this coverage, we would ask that you contact our Sidney headquarters office for further details.

We are also able to make available insurance for Occupational First Aid Attendants and once again, it is priced lower than any available comparable insurance in Canada. For those companies who have more that one mobile treatment vehicle, we should add that we are presently working on a volume insurance discount.

The Liability / Errors & Omissions insurance that we have available has features that make it unique in the industry; one plan for all training. The definition of professional services provides coverage for teaching classes in CPR, Automated External Defibrillation (AED), First Aid, Emergency Medical Care and Occupational First Aid Attendants (professional coverage). Instructors can be multi-disciplined and all of their training will fall under the coverage scope of the plan - there is no need to buy separate policies for different training classes.

One of the greatest benefits of Professional Liability Insurance is legal defense costs. Legal fees can quickly escalate when defending claims. In addition to legal defense costs, the insurance plan covers settlement costs or final judgment should an instructor ever lose a case in litigation.

The whole MEDIC FIRST AID industry is moving toward greater involvement in occupational first aid training. This brings with it new opportunity and greater accountability which emphasized the need for continuing education and the ability to accept change. It also emphasizes the ever-increasing need for our Training Centres, Trainers and Instructors to secure insurance coverage. In this light, we understand that Red Cross has already made it mandatory for their instructor membership to be insured, which is part of their instructor renewal process. With this in mind, we have now secured an insurance opportunity for our Training Centres, Trainers and Instructors and this has been done solely to assist our membership.

To further explain, insurance is not designed to pay an award that is the result of a suit being levied against a Trainer/Instructor. What it is designed to do it to provide and adequate defense should a suit be levied against a Training Centre, Trainer or Instructor.

When a suit is put in motion against an individual, it automatically requires that an adequate defense be put forwards asa response to that suit. This invariably is an expensive undertaking (i.e. lawyers' fees, etc.) at the end of which an individual is found to be free of reproach. However, the process in defending the suit has perhaps cost that same individual all of their savings including their house and properties. Hence, the need for insurance.

  1. Is insurance an integral component of the instructor membership teaching status renewal?

    Answer: Yes, but this more importantly applies to those instructors who are teaching occupational first aid (workplace responders)

  2. Insurance does not necessarily mean EMP Canada insurance.

    It can be insurance from any other source that meets the same requirements.

    i.e. colleges, Training Centres and major corporations will have insurance that places an umbrella over their instructors. An example of this would be the City of Calgary. In these instances, it should be possible to secure a memo or letter form the organization which will list their instructors and identify that those same instructors ar covered by the corporation's insurance. This is totally acceptable for our instructor membership renewal purposes.

  3. In the event that an EMP Canada instructor member teaches only within the local community or for organizations such as recreational centres, boy scouts, cubs, etc., then with a letter identifying that they will not teach any occupational first aid programs, their renewal will be processed on that basis.

  4. It is possible that a home owner's insurance for some of the instructors will cover their operations and hence, they are insured. However, in all these cases we do need a copy of a letter or certificate from the insurance company describing the coverage.

  5. In those instances where there is an ambulance service such as Bonneville Ambulance Service or Brooks Ambulance, or the City or Calgary EMS. They most assuredly would have an insurance policy covering all of their Responders/ambulance service members and in turn the coverage would umbrella all of their EMP Canada instructors.

  6. In British Columbia, because of the occupations first aid involvement of almost all of our instructors, trainers and evaluator they need errors and omissions insurance to protect themselves as they are training occupational first aid attendants.

Claims-Made Liability Policies Vs Occurrence Based Liability Policies

Occurance Based Liability Policy

Under an occurence-based liability policy, as long as an insured loss occurred during the time that the policy was in effect, the claim will be covered even if the policy is no longer in effect at the time that the notice of claim is presented.

Claims-Made Liability Policy

Under claims-made liability policy, in order for a loss to be covered, not only must the policy have been in effect at the time of the loss, it must also be REPORTED while the policy is still in effect.

This type of policy can create serious gaps in coverage if an insured does not receive notice of a claim until after a policy is no longer in effect such as in the following instances:

a) A policy lapsed or cancelled

b) An insured is replacing a claims-made policy with another carrier

In order to avoid these gaps in coverage an Insured usually has the following options available to them:

1) Purchase of an Extended Reporting Period Endorsement from current carrier (must be purchased at the time the original policy is arranged)

2) Purchase of "Prior Acts Coverage" from the current carrier before the policy is lapsed or cancelled

3) Purchase of "Prior Acts/Retroactive" Coverage from the new insurance carrier at the time the new policy is arranged.
